Terms and Conditions of Use

COSMOPIX ('we', 'our', or 'the company'), the developer of the game GALAXYMUS DUNGEONS ('the app', 'the game'), presents its Terms of Use and Conditions ('Terms of Use', 'these Terms'), outlining the rules governing the relationship between the company and the app users.

1. Purpose and Acceptance of Terms

  • These Terms aim to clarify the relationship between the developer company and the user who, freely and with consent, has chosen to download and use the app.
  • By using the app, the user fully agrees to the rules established herein and acknowledges that they may face penalties as outlined in these Terms if they fail to comply with the stated limitations.
  • The user also acknowledges and agree on the Terms of Use of the marketplace used to download the app.

2. License of Use

  • The app is available on marketplace platforms to be freely downloaded and used. However, this does not grant users full rights to perform certain actions. For instance, the use of the game is based on a license granted by the company to the user, not a sale of the app as property.
  • The permission granted to users, or License of Use, is as follows:
    • Limited: The user is not allowed to copy, modify, sell, or distribute the app without the company’s explicit authorization.
    • Revocable: In cases of violation of these Terms, the company reserves the right to revoke the user's permission to access the app.
    • Non-exclusive: The app is available for use by anyone with access to a mobile device and the marketplace where the game is distributed.
    • Non-transferable: The license applies solely to the user who downloaded the game and cannot be transferred to other individuals for any reason.

3. Gameplay Sharing on Social Media or Video Platforms

  • The company allows users to record their gameplay and share it on their social media or stream it on video or streaming platforms. This content is permitted to be monetized.
  • However, users are not allowed to use this permission to share content that harms the image of the game, the company, or other users. It is also prohibited to associate the game or the company with sensitive, violent, or forbidden content. Posts, videos, or streams must not place the game or the company alongside prohibited content, including that which promotes illegal activities or pornography.
  • Violation of these rules may result in suspension or termination of the app's license, as well as legal or administrative actions from the company for any damage caused to its image or the app's reputation. In such cases, the user agrees to delete any photos, videos, or streams that remain in violation of the rules outlined above.

4. Privacy Policy

  • COSMOPIX cares about the data collected through its website and apps. For this reason, our full Privacy Policy is available on our website, outlining the data collected, processed, and shared within our app.

5. Age Range and Minors

  • The app targets all individuals interested in mobile platform entertainment, with no age restrictions. The absence of features like chat ensures a space that is emotionally safe for users, making it a secure environment for anyone who wants to enjoy the app’s content.
  • However, the collection of information, ad targeting, and financial transactions require special attention when the user is a minor. In these cases, the app will provide an option to declare whether the user falls into this category, and then require a legal guardian to express consent for the minor to access the app. This consent will be obtained via a mandatory checkbox during account creation or gameplay, with the following declaration:
    • 'I am the parent or legal guardian of this minor and I grant permission for them to access and use this game’s content.'
  • If we discover that a minor is accessing our game without a legal guardian express consent, we will restrict the user access until the requirement above is fulfilled.

6. Purchases and Transactions

  • The game GALAXYMUS DUNGEONS features a mixed-currency system, which can be earned through gameplay or purchased with real money within the app.
  • Additionally, the app offers recurring subscriptions, which provide exclusive benefits for the duration of the subscription. These subscriptions are processed through the payment systems of the app stores (Google Play Store or Apple App Store), adhering to the policies and terms set by these platforms.
  • The user acknowledges that the app is not responsible for any transactions that are not handled through the marketplace.
  • Virtual currency and subscription benefits are non-transferable and valid only for the user who acquired them.
  • All transactions, including recurring subscriptions, are conducted through third-party marketplaces (Google Play Store or Apple App Store). Applicable rules, including cancellations and refunds, follow the policies of these platforms. We recommend all users review the Terms to understand the Privacy Policy.

7. Ads and Advertising

  • The company sells ad space within the app, either directly or through specialized services for this purpose.
  • COSMOPIX clarifies that the ads do not represent the company’s opinion or endorsement, and it is not responsible for the products advertised or their functionality.
  • The app will clearly indicate when the content is an ad rather than a feature of the app itself.
  • Ads may be personalized based on the user’s search history, according to the rules of the company selected to provide this service within the app.
  • All ads are optional. The game will not force an ad unto a player, only suggest that a user see one to receive a bonus in-game.

8. Copyright and Intellectual Property

  • All assets of the app, including the logo, soundtrack, visual assets, code, and anything else that can be protected by copyright and intellectual property laws, are owned by the company.
  • Violation of intellectual property rights may result in the revocation of the License of Use and may also allow the developer company to seek legal remedy.

9. Responsibilities and Guarantees

  • The developer company provides the app on marketplace platforms and is responsible only for the published versions. Older, pirated, or modified versions by third parties are not the company’s responsibility.
  • COSMOPIX is also not responsible for any damages resulting from the use of the app, as it is designed solely as a simple entertainment game, not requiring excessive physical movement, long-distance travel, or the use of technologies beyond the mobile device.

10. Termination and Suspension

  • The user may be penalized with account suspension or termination, depending on the severity of their violation of the rules outlined in these Terms.
  • The following behaviors will result in penalties for the user: copying, modifying, selling, or distributing the app without permission; contributing to a security breach or data leak of the company or other users; abusing in-game currency purchase rules; financial fraud; violating the company’s copyrights or intellectual property; circulating pirated or modified versions of the app without the company’s permission; defamation, slander, or insults aimed at damaging the company’s public image.
  • If necessary, for updates or security reasons, the app’s services may be temporarily suspended until the situation is resolved.
  • COSMOPIX may terminate the app’s availability at any time, without prejudice to users who wish to keep the game installed, thereby ending any liability on the part of the company.

11. Updates and Modifications

  • The app may receive automatic updates to improve performance, security, or add new features to the game.
  • These Terms of Use and Conditions may be updated to include new rules as the game progresses. In such cases, the company will notify players as soon as they open the app, informing them of the change.

12. Applicable Law

  • In case of a dispute, the applicable law for resolution is Brazilian law. The jurisdiction for filing actions related to the company and its apps is the court in Curitiba, State of Paraná.
